BigDragonMerch Printing Terms of Service

By ordering any of our products you agree to these Terms of Service

You should print a copy of these Terms for future reference.

By placing any order with us, you confirm that you are at least 18 years old and are legally capable of entering into binding contracts. After your order is complete, you will receive an order completion email from us acknowledging that we have completed your order and that it is ready for delivery. 

Availability and delivery:

All orders are subject to acceptance by us and we will inform you if for any reason we cannot process your order. 

If you have opted for at convention delivery/pickup, you will be updated to confirm your order is complete and ready to pick up in the dealers den.

Your order will typically be fulfilled within 5 working days. In exceptional circumstances or in the case of a bespoke order we may inform you of a new delivery date. If you are collecting in person at a convention and this is no longer possible, we will reach out to you to discuss delivery options.

Specifications and Legal:

We try to replicate as accurately as possible the printed products as they appear on digital screens however cannot give assurance that the colours of products supplied will exactly match those displayed on your computer monitor or other printing systems. We do however offer a bespoke proofing service and will reach out to you if the printed product doesn’t match our standards for print quality and accuracy.

In supplying any files to be printed, for the purpose of an order, you agree and warrant to us that such material:

is accurate (where it states facts);

is genuinely held (where it states opinions);

complies with applicable law in the UK and any country from which it is submitted;

does not contain any material which is defamatory of any person;

does not contain any material which is obscene, hateful or inflammatory;

does not promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

does not infringe any intellectual property rights of any other person

and you will indemnify (and keep indemnified) us for any breach by you of such above warranties.

We are a print ready company and will print from the artwork that is provided to us by the customer. It is the customers responsibility to ensure that all artwork is compliant with copyright laws and regulations (including any wording or imagery used).

Daniel Jones/BigDragonMerch can not be held responsible for any breach of these laws/regulations.

All products are printed by us strictly in accordance with any file submitted by you to us with your order. To the extent permitted by law, we accept no liability in respect of unwanted or defective products where such defect relates to an error in the file submitted by you to us.

Inconsistency between the digital file and your physical order is manually reviewed to ensure the artistic quality of photo/art prints passes our internal review. In the event that a supplied file prints at an unacceptable quality, we will reach out to you as the client to discuss options on file edits or our bespoke proofing service to bring the final physical print quality up to our standards. This will be done before completing your order as we give the client the opportunity to amend files that are producing poor printing results before completing and shipping an order.

Refunds, returns and reprints:

It is not possible to return products for refund other than in the event of an order being produced to the wrong order specification or not to an acceptable standard. In either of these cases we may (at our discretion) reprint free of charge. Any errors in printing must be reported via e-mail to the following email address bigdragonmerch@gmail.com

Please make sure to include your invoice number in the subject line. In order to qualify for a full or partial refund you will need to email us within 7 days of receiving your order. We will also require you to return a sample or photographic evidence of the issue.

We will notify you of any refund due to you via email within a reasonable period of time and will usually process the refund due to you within 30 days of the day we confirmed to you that you were entitled to a refund. We will refund the price of a defective product in full and any applicable delivery charges and any reasonable costs you incur on returning the item to us.

If the packaging of your order has been damaged, please accept the material from the courier and write on the document provided that you have accepted the package subject to checking. Once you have verified damage has occurred to the material inside the package you must contact our customer service team at bigdragonmerch@gmail.com so we can process and reprint your order immediately.

If, when delivered, the printed product cannot be used because there is no packaging or the contents are completely ruined, please DO NOT accept the material and mark the refusal on the document provided by the courier. You must then contact our customer service team at bigdragonmerch@gmail.com to inform us of the issue so we can proceed and reprint your order immediately. We cannot accept a claim for loss for items delivered via Royal Mail unless 15 working days or more have passed since the item was due to be delivered.

Warranty:

We warrant that any product purchased from BigDragonMerch Printing, on delivery, conform (in all material respects) with its description (including any file provided by you), be of satisfactory quality, and be reasonably fit for purposes commonly associated with the product.

Our Liability:

We will not be liable for losses that result from our failure to comply with the Terms that fall into the following categories:

a) loss of income or revenue;

b) loss of business;

c) loss of profits;

d) loss of anticipated savings;

e) loss of data;

f) waste of management or office time.

Nothing in these Terms excludes or limits our liability for:

death or personal injury caused by our negligence;

fraud or fraudulent misrepresentation;

any breach of the obligations implied by: 

  • Section 12 of the Sale of Goods Act 1979 
  • Section 2 of the Supply of Goods and Services Act 1982
  • Defective products under the Consumer Protection Act 1987 

Or any other liability that it would be illegal or unlawful to limit or exclude liability for.

If we fail to comply with these Terms we shall only be liable to you for the purchase price of the products.

Please note that it is your responsibility to comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.

Circumstances beyond our control:

There may be occasions when we are unable to fulfil an order within your required timescales, or at all, as a result of circumstances or events beyond our reasonable control. 

Such circumstances and/or events include any acts, events, non-happenings, omissions or accidents beyond our reasonable control including without limitation:

  • Strikes, lock-outs or other industrial action
  • Terrorist action or the threat thereof
  • Civil commotion, disruption due to general or local elections 
  • Invasion, war, threat or preparation for war 
  • Fire, explosion, storm, hurricanes, flood, earthquake or other natural physical disaster
  • Epidemic or pandemic, quarantine and any legislation, official advice or guidance, regulation or ruling (including failure to grant any necessary permissions) or actions of any government, court or other such competent authority. 

If such circumstances or events arise and they appear likely, in our reasonable opinion, to impact upon the delivery of products and/or the performance of any other obligation by us then we will use reasonable endeavours to inform you that your order has been delayed and we shall have no liability to you for any delay. If the period of delay continues for more than 30 days then you will be entitled to cancel your order by notifying us by email to bigdragonmerch@gmail.com and you will receive a full refund.

Our right to vary these terms and conditions:

We have the right to revise and amend these Terms from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities.

You will be subject to the policies and Terms in force at the time that you order products from us, unless any change to those policies or Terms is required to be made by law or governmental authority. In this case it will apply to orders previously placed by you, or if we notify you of the change to those policies or these terms and conditions before we send you the order confirmation email. In this case we have the right to assume that you have accepted the change to the Terms, unless you notify us to the contrary within seven working days of receipt by you of the products.

Entire agreement and third party rights:

These Terms (and any document expressly referred to in them) constitute the entire agreement between us and supersedes all previous discussions, correspondence, negotiations, previous arrangement, undertaking or agreement between us relating to the subject matter of any contract.

We each acknowledge that in entering into a contract, neither of us relies on any representation or warranty (whether made innocently or negligently) that is not set out in these Terms or the documents referred to in them.

A person who is not party to these Terms or a contract shall not have any rights under or in connection with them under the Contracts (Rights of Third Parties) Act 1999.

Law and jurisdiction:

Contracts for the purchase of products through BigDragonMerch and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English Law. Any dispute or claim arising out of or in connection with such contracts or their formation (including non-contractual disputes or claims) will be subject to the exclusive jurisdiction of the Courts of England and Wales.

Privacy Policy:

At BigDragonMerch, we are committed to protecting and respecting your privacy and data. Throughout this policy, when we write BigDragonMerch or BigDragonMerch Printing, “we” or “us,” we’re referring to the self employed Sole Trader work carried out by Daniel Jones and any outsourced/contracted work that is overseen and approved by Daniel Jones.

Information we collect and use:

Information BigDragonMerch collects about you:

When you interact with our Services, we collect Information that, alone or in combination with other data, could be used to identify you (“Personal Data”). Some of the Information we collect is stored in a manner that cannot be linked back to you (“Non-Personal Data”).

Information you provide when creating an order:

When you sign up for or use our Services, you voluntarily give us certain Personal Data, including:

  • Your name, email address, classification and contact details.
  • Paypal email if paying via Paypal.
  • Your payment information if paying by card/stripe or bank transfer. 

BigDragonMerch does not store any card or bank account data beyond your name and payment amount.

This information is required to complete an order transaction with BigDragonMerch. We use this information to enable and fulfil your transaction. By choosing to pay by debit/credit card for your order, you will provide your card number and details directly to the third-party processing company [Stripe]. We are not responsible for the credit card processors activities. The privacy policy of the credit card processor will apply to the information you provide.

Other Information we collect: 

  • User Content. This consists of all text, documents, or other content or information uploaded, entered, or otherwise transmitted by you in connection with your use of the Services.
  • User Artwork. This applies to all supporting artwork or photography uploaded for the sole purpose of printing your chosen products.
  • Delivery addresses. This applies to all addresses used to deliver print products to and to provide paper service communications such as Invoices.

Does BigDragonMerch review User Content and/or User Artwork?:

As a rule, BigDragonMerch and any freelance/contracted individuals working under BigDragonMerch will view your User Content and/or User Artwork that you have supplied to us.

If we believe our Terms and Conditions have been violated and confirmation is required we will contact you on the same communication channel you initiated your order with, if we need to do so to respond to your requests for user support, if we otherwise determine that we have an obligation to review it as described in the Terms and Conditions, or to improve our customer service to deliver you a better experience.

In addition, if you request that we review and/or correct any User Artwork supplied under our full proofing service, our artwork team may also read or view the User Artwork you submit , as this will be necessary to complete any corrections or amendments to artwork supplied by you in order that we can print and fulfil any orders you have placed relevant to such User Artwork submitted.

Finally, your submitted Information will be viewed where necessary to protect the rights, property, or personal safety of BigDragonMerch and its users, or to comply with our legal obligations, such as responding to warrants, court orders, or other legal processes.

Information access and disclosure:

Does Printed.com share my Information?

We only disclose Personal Data to third parties when one of the following circumstances apply:

  • We have your explicit consent to share your Personal Data.
  • We use service providers who assist us in meeting operational business needs, including hosting, delivering, and improving our Services. We also use service providers for specific services and functions, including email communication, customer support services, and analytics. These service providers may only access, process, or store Personal Data pursuant to our instructions and to perform their duties to us, and are all working under appropriate written processing agreements with us.
  • We believe it is necessary to investigate potential violations of the Terms and Conditions, to enforce those Terms and Conditions, or where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, or potential threats against persons, property, or the systems on which we operate our Site and/or Services.
  • We determine that the access, preservation, or disclosure of your Personal Data is required by law to protect the rights, property, or personal safety of BigDragonMerch and users of our Services, or to respond to lawful requests by public authorities, including but not limited to, law enforcement requests.

BigDragonMerch does not share your Personal Data with third parties for the purpose of enabling them to deliver their advertisements to you.

User Artwork is never shared with third party print providers as all required services are completed in-house by the BigDragonMerch team.

Data storage, transfer, retention, and deletion:

Where is my Information stored?

Information submitted to BigDragonMerch will be transferred to, processed, and stored in the UK. When you use our Services on your computer device, User Content and User Artwork you save and send to us will be stored locally on our work machines. If you post or transfer any Information to or through our Services, you are agreeing to such Information, including Personal Data and User Content, being hosted and accessed in those locations.

How secure is my Information?

BigDragonMerch is committed to protecting the security of your Information and takes reasonable precautions to protect it. However, the transmission of information via the Internet is not completely secure. We use Gmail and Telegram as our primary method of contact with clients which aren’t encrypted by default.

We will do our best to protect your Personal Data, User Content and User Artwork, however we cannot guarantee the security of your data transmitted to the Site and/or Services; any transmission is at your own risk. Once we have received your information we will use strict procedures and security features in order to reduce the risk of unauthorised access.

If BigDragonMerch learns of a security breach, we may attempt to notify you and provide information on protective steps, if available, through the email address or any other communication channels that you have provided to us.

Your rights relating to you Personal Data, User Content and User Artwork:

The right to be informed about how your Personal Data is being collected and used

The right to access the Personal Data we hold about you

The right to request the correction of inaccurate Personal Data we hold about you (although you can do most of this through My Account)

The right to request that we delete your Personal Data

The right to stop direct marketing messages, this again can be done through My Account)

The right to complain to your data protection regulator — in the UK via the Data protection complaints website or the Information Commissioner’s Office via their helpline: 0303 123 1113

How long is Personal Data retained?:

We may keep some of your Personal Data for as long as reasonably necessary for our legitimate business interests, including fraud detection and prevention and to comply with our legal obligations including tax, legal reporting, and auditing obligations for up to 6 years.

When User Artwork is sent to BigDragonMerch it is hosted locally on 2 machines before being printed. The original User Artwork is deleted immediately after we create a “print-ready” artwork file, but the “print-ready” artwork file is stored indefinitely for us to provide the service to you, for example to allow you to reorder. These files will never be printed again unless through your consent for any promotional material or a reorder.

Will this Privacy Policy ever change?

At BigDragonMerch we are constantly evolving and we may need to update this Policy in the future to keep pace with changes in our Site and Services, our business, and laws applicable to us and you. Effective dates and updates will be posted on this page.

We will always maintain our commitment to respect your privacy and endeavour to notify you of any material changes that impact your rights under this Policy by email (as known to us in your Personal Data). Please note that your continued use of Printed.com after any change means that you agree with, and consent to be bound by, this Privacy Policy as updated from time to time.
